Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Feasly platform and related services (the "Service") provided by Feasly Technologies (DIFC) Ltd (DIFC Registration No. 10981) ("Feasly", "we", "us", "our"), a company incorporated in the Dubai International Financial Centre, Dubai, United Arab Emirates.

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. The Service

Feasly provides a cloud-based real estate feasibility and financial modelling platform. The Service enables users to create, manage, and analyse real estate development feasibility models.

The Service is a modelling tool. Outputs generated by the Service are based on the assumptions and data you provide. Feasly does not provide financial, investment, legal, or tax advice. You are solely responsible for the assumptions you input and the decisions you make based on model outputs.

3. Account registration

To use the Service, you must create an account and provide accurate, complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately at [email protected] if you become aware of any unauthorised use of your account.

4. Subscription and payment

Access to the Service is provided on a subscription basis as described on our pricing page. All prices are quoted in US Dollars and are exclusive of applicable taxes, including UAE Value Added Tax (VAT) at the prevailing rate.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. We will provide reasonable notice before any price changes take effect.

5. Your data

You retain all rights to the data you upload to or create within the Service ("Your Data"). We do not claim any ownership interest in Your Data.

You grant us a limited licence to host, store, process, and display Your Data solely for the purpose of providing the Service to you. This licence terminates when you delete Your Data or close your account.

We will not access, use, or share Your Data for any purpose other than providing the Service, unless required by law or with your explicit consent. For details on how we handle personal data, see our Privacy Policy.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to the Service or other users' data
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to store or transmit malicious code
• Resell, sublicense, or redistribute access to the Service without our written consent
• Use automated tools to scrape or extract data from the Service

7. Intellectual property

The Service, including its design, features, code, documentation, and branding, is owned by Feasly Technologies (DIFC) Ltd and is protected by intellectual property laws. Feasly^® is a registered trademark.

These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

8. Service availability and support

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice.

Support is provided via email at [email protected]. Response times and support levels vary by subscription plan. Enterprise customers may negotiate separate service level agreements (SLAs).

9. Limitation of liability

To the maximum extent permitted by law, Feasly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total aggregate liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Feasly does not warrant that the Service will be error-free or that outputs will be accurate or complete. All model outputs are tools for analysis and do not constitute financial, investment, or professional advice.

11. Termination

You may cancel your subscription at any time through your account settings or by contacting [email protected].

We may suspend or terminate your access to the Service if you breach these Terms, subject to reasonable notice where practicable.

Upon termination, your data will remain available for export for 30 days, after which it will be securely deleted from our systems.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC).

Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the DIFC Courts.
