Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Feasly platform and related services (the "Service") provided by Feasly Technologies Ltd (DIFC Registration No. 10981) ("Feasly", "we", "us", "our"), a company incorporated in the Dubai International Financial Centre, Dubai, United Arab Emirates.

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

Feasly provides a cloud-based real estate modelling platform with Development feasibility, Underwriting and related financial analysis. Available functions depend on the product, access arrangement and supported integration. These Terms also apply to the Feasly integrations and APIs we make available, including Feasly in ChatGPT.

The Service is a modelling tool. Outputs generated by the Service are based on the assumptions and data you provide. Feasly does not provide financial, investment, legal, or tax advice. You are solely responsible for the assumptions you input and the decisions you make based on model outputs.

Some quick-appraisal features can be used without a Feasly account and do not automatically create a saved workspace model. Saving, opening or changing a workspace model requires the applicable account connection and permissions. A third-party platform may separately require its own account. When an account is required, provide accurate, complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately at [email protected] if you become aware of any unauthorised use of your account.

Your access arrangements, subscription fees, billing currency, applicable taxes and payment schedule are set out in the plan, order form or other agreement provided to you. Contact the Feasly team for current access and pricing information.

Renewal and cancellation arrangements are those disclosed in your subscription agreement. We will provide reasonable notice before any price changes take effect.

Refunds are handled on a case-by-case basis. Contact [email protected] for billing enquiries.

You retain all rights to the data you upload to or create within the Service ("Your Data"). We do not claim any ownership interest in Your Data.

You grant us a limited licence to host, store, process, and display Your Data solely for the purpose of providing the Service to you. This licence terminates when you delete Your Data or close your account.

We will not access, use, or share Your Data for any purpose other than providing the Service, unless required by law or with your explicit consent. For details on how we handle personal data, see our Privacy Policy.

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or other users' data
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or transmit malicious code
  • Resell, sublicense, or redistribute access to the Service without our written consent
  • Use unauthorised automated tools to scrape or extract data from the Service

This restriction on unauthorised automation does not prohibit the supported Feasly APIs, ChatGPT integration or export functions, used as documented and within your permissions and limits. Connecting an account can allow authorised reading, creation, import and changes to workspace models. Authorise only actions you intend and review important changes and results. The connected platform's terms and privacy arrangements also apply to information passing through it; review our ChatGPT privacy and support notice before connecting or uploading a file.

The Service, including its design, features, code, documentation, and branding, is owned by Feasly Technologies Ltd and is protected by intellectual property laws. Feasly® is a registered trademark.

These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice.

Support is provided via email at [email protected]. Response times and support levels vary by subscription plan. Enterprise customers may negotiate separate service level agreements (SLAs).

To the maximum extent permitted by law, Feasly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total aggregate liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Feasly does not warrant that the Service will be error-free or that outputs will be accurate or complete. All model outputs are tools for analysis and do not constitute financial, investment, or professional advice.

To request cancellation, contact [email protected]. The effective date and any remaining billing obligations depend on your subscription agreement.

We may suspend or terminate your access to the Service if you breach these Terms, subject to reasonable notice where practicable.

Contact us before closing your account to arrange an export of your data. Export, deletion and retention are handled in accordance with your agreement and our Privacy Policy, including applicable record-keeping obligations. Existing agreed export or retention commitments continue to apply. Moving a project to recoverable Trash does not immediately erase saved models, original import files, versions or results; permanent expiry follows the retention schedule and any applicable preservation hold in the Privacy Policy. Later reductions to retention for existing customer data follow the notice requirements in that policy. Disconnecting an integration does not delete saved workspace content. Contact [email protected] for permanent erasure or other privacy rights requests. This description of storage does not extend the licence in section 5 or grant rights to use retained data beyond your agreement and applicable law.

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC).

Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the DIFC Courts.
